Terms of Use, Limited Warranty & Liability Waiver

STRATA by Southwest Composite Works ("STRATA") provides its products subject to the following terms, conditions, and notices. These terms apply to all purchases and use of STRATA products. Please read them carefully.

By purchasing, keeping, using, or allowing others to use any STRATA product, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, you may return the unused product within 14 days of purchase in accordance with our return policy.

Terms of Use

This product is provided subject to your acceptance of these terms without modification.

You may not modify, reproduce, distribute, publish, license, create derivative works from, transfer, or sell any materials, content, software, or products obtained from STRATA or its website except as permitted by applicable law.

Limited Warranty

STRATA warrants its products against manufacturing defects for a period of one (1) month from the original date of purchase.

This warranty does not cover damage resulting from:

• Normal wear and tear
• Misuse or abuse
• Improper installation or mounting
• Unauthorized modifications
• Neglect or improper maintenance
• Accidents or impacts

If you believe your product has a manufacturing defect, please contact STRATA before returning the product.

High-Risk Activity Warning

STRATA products are intended for use in activities that involve inherent risks, including climbing and climbing training.

Participation in these activities carries significant risks, including but not limited to serious injury, permanent disability, or death. No product can eliminate these risks.

You are solely responsible for evaluating whether you possess the necessary skills, experience, and judgment to safely use this product.

Assumption of Risk

By purchasing, using, or permitting others to use a STRATA product, you voluntarily acknowledge and assume all risks associated with climbing, climbing training, and related activities.

To the fullest extent permitted by law, you expressly assume all risks of personal injury, disability, death, property damage, or other loss arising from the use or misuse of this product, whether resulting from equipment failure, improper use, or any other cause.

You further agree to indemnify and hold harmless STRATA by Southwest Composite Works, its owners, employees, affiliates, distributors, and representatives from any claims, damages, liabilities, or expenses arising from your use of the product.

Limitation of Liability

To the fullest extent permitted by law, STRATA's sole responsibility under this warranty is limited to the repair or replacement of a defective product.

In no event shall STRATA's liability exceed the original purchase price of the product.

STRATA shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use or misuse of any STRATA product.

Product Warning

Improper use of climbing equipment or climbing training products can result in serious injury, permanent disability, or death.

Users assume all responsibility and risk associated with the use of this product.

Inspect Before Every Use

Before each use, carefully inspect this product for signs of wear, damage, cracks, deformation, loose components, or any other condition that could affect its safety or performance.

Do not use this product if it appears damaged or if you have any reason to believe it may be unsafe. If the product is within the warranty period and you believe it contains a manufacturing defect, contact STRATA for evaluation.

Entire Agreement

This Product Liability Disclaimer constitutes the entire agreement between you and STRATA regarding the use of its products.

If any provision of this disclaimer is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

This disclaimer and all purchases from STRATA by Southwest Composite Works shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

Any legal action arising from the purchase or use of STRATA products shall be brought exclusively in the appropriate state or federal courts located in New Mexico, and you consent to the jurisdiction of those courts.

Modification of Terms

STRATA reserves the right to modify these terms and conditions at any time without prior notice. The most current version will apply to all products sold after the effective date of any revision.
